What is a cut-off date?

Cut-off date (date of registration of affected persons' eligibility)

The date on which the Provincial Resettlement and Livelihood Restoration Management Committee, or another competent authority, approves the registration of the people, land and assets within the project area that may be affected by the project. Any activity carried out after this date (for example new buildings, new crops or people moving in) is not eligible for compensation from the project owner. The exception is where the compensation plan is not implemented within 12 months of the cut-off date, in which case the compensation must be re-evaluated. (Decree No. 84/GOV of 5 April 2016, Article 8, points 10 and 12; Law on Resettlement and Vocation No. 45/NA of 15 June 2018, Article 22, clauses 12 and 13.)

Benefit during the period of lost opportunity

The return from carrying on an activity, such as a business, that an affected person receives as compensation from the resettlement and vocation project for a period of three years. (Law on Resettlement and Vocation No. 45/NA, Article 3, clause 13.)

Transition period

The period for restoring the livelihoods of affected people, lasting three to five years from the date of relocation. (Law on Resettlement and Vocation No. 45/NA, Article 3, clause 15.)
